Terms of Use

1. The service

Pidgely is an API that lets developers send email (and, later, other channels) from their applications, with domain authentication, delivery events, webhooks and deliverability tools.

Early access: while the program lasts, features, limits and prices may change, and the service is provided without a formal availability commitment. We will tell you before changes that affect you.

2. Account and keys

• Provide accurate information and keep it up to date.
• Keep your API keys secret. You are responsible for activity carried out with them and for your team members.
• You may only send from domains you control. Each domain can be verified by one account.

3. Acceptable use and anti-spam rules

You agree to send only email that recipients expect, and not to:

• send unsolicited bulk email or use purchased, rented or scraped lists;
• send phishing, malware, fraud, illegal content or content that infringes third-party rights;
• hide or forge your identity, or make it hard to unsubscribe;
• try to bypass limits, the sandbox or our security controls.

To report spam or abuse sent through Pidgely, write to abuse@pidgely.com; we investigate every report.

You are responsible for having a legal basis to email your recipients and for honoring unsubscribe requests, under the laws that apply to you (such as the LGPD, GDPR and CAN-SPAM).

To protect recipients and every other sender, we may limit, pause or suspend sending automatically when bounce or complaint rates show a risk, and we may suspend accounts that breach these rules.

4. Data processing

For the personal data in your messages, you are the controller and we are your processor: we process it only to provide the service and according to your instructions, as described in the Privacy Policy. A data processing agreement (DPA) is available on request at privacy@pidgely.com.

5. Plans and billing

Plans, included volumes and prices are shown on the website in US dollars. Paid plans are billed monthly; email above the included volume is billed per 1,000 messages. Price changes are announced in advance and apply from the next billing period. The free plan has daily and monthly limits.

6. Intellectual property

The Pidgely brand, mascot, website, documentation and software belong to us. You keep all rights to your content. We grant you a non-exclusive, non-transferable right to use the service while your account is active.

7. Availability and liability

We work to keep Pidgely fast and available, but the service is provided "as is". Email delivery also depends on systems we do not control, such as recipient mail servers and spam filters, so we cannot guarantee that a message will reach the inbox.

To the extent permitted by law, we are not liable for indirect damages or lost profits, and our total liability is limited to the amount you paid us in the 12 months before the event.

8. Termination

You can stop using Pidgely and close your account at any time (see how to delete your account). We may suspend or close accounts that breach these Terms, with notice whenever possible.

9. Law and jurisdiction

These Terms are governed by the laws of Brazil. The courts of São Carlos/SP, Brazil, have jurisdiction, without prejudice to first seeking an amicable solution.
